Terms & Conditions

Service Provider: The Car Remarketing Company, operating as My AI Phone Rep
These Terms & Conditions govern your use of the My AI Phone Rep website and services. By purchasing or using our services, you agree to these terms. If you act on behalf of a business, you confirm that you have authority to accept them.

1. Our Services
My AI Phone Rep provides custom AI phone agents and customer service support. Services may include answering inbound calls, making authorized outbound calls, responding to questions, capturing leads, scheduling appointments, and assisting with sales.
Your written service agreement or accepted order will identify the features, integrations, service hours, usage limits, and support included in your plan. Submitting an inquiry does not purchase or activate a service.

2. Setup and Approval

You must provide the information and access reasonably needed to configure your service. Setup timelines depend on receiving complete information, your approvals, and any required third-party connections.
Before launch, you are responsible for reviewing and approving your agent’s greeting, knowledge base, pricing, instructions, and permitted actions. Material changes or additional features may require a separate quote.

3. Business Information and Knowledge Base

You are responsible for the accuracy and lawful use of the information you provide, including documents, FAQs, product descriptions, prices, policies, and customer contact details.

You authorize us to use this information to configure, operate, and support your service. You retain ownership of your materials and must notify us when information needs updating.
Do not provide passwords, full payment card details, or sensitive personal information unless we have expressly agreed to an appropriate secure process.

4. AI Limitations and Human Review

AI agents may misunderstand requests, provide inaccurate responses, or fail to complete a task. You should review performance and promptly report errors.
We do not guarantee a particular number of answered calls, appointments, leads, sales, or revenue. Dashboard examples and sample figures are illustrations, not promises of results.
Unless expressly authorized in your service agreement, an agent may not make binding commitments, approve refunds, change prices, or enter contracts on your behalf.
Our services are not emergency services or a substitute for professional medical, legal, or financial advice.

5. Calls, Messages, and Consent

You must use the services lawfully and provide contact lists that you are authorized to use. Where required, you must obtain and maintain appropriate consent for calls, messages, recordings, and automated or AI-generated communications.
You must provide accurate caller identification, required notices, and instructions for honoring opt-outs and do-not-call requests. Notify us promptly of any revoked consent or contact restriction.
We may decline or pause campaigns that lack appropriate authorization or appear unlawful. Each party remains responsible for its own legal obligations; these terms do not transfer responsibilities that cannot legally be transferred.

6. Recordings and Customer Data

Depending on your agreed configuration, services may process contact information, recordings, transcripts, appointment details, and other business data.
Before enabling recordings or transcription, the parties must agree on the required notices, consent process, access permissions, and retention settings. Data handling is subject to the applicable Privacy Policy and any separate data processing agreement.

7. Fees and Payment

Your accepted order or service agreement will state setup charges, recurring fees, included usage, additional usage charges, taxes, and payment dates.

Recurring billing applies only when you have expressly authorized it. Changes to pricing will apply prospectively, with notice before they take effect.

If payment is overdue, we may suspend services after notice and a reasonable opportunity to resolve the issue, except where immediate action is reasonably necessary.

8. Cancellation and Refunds

Cancellation procedures, notice periods, and refund eligibility must be disclosed in your accepted order or service agreement before purchase.
Cancellation does not remove your obligation to pay charges properly incurred before the cancellation takes effect. Any mandatory rights provided by applicable law remain in effect.
To request cancellation or discuss a billing issue, email support@autopartsremarketing.com.

9. Third-Party Services

Our services may rely on telephone carriers, AI platforms, scheduling systems, payment processors, and other providers. Their availability, restrictions, and terms may affect your service.

Features such as text messaging, appointment booking, call transfers, or payment links require the appropriate connections and permissions. We do not guarantee uninterrupted operation of third-party systems.

10. Acceptable Use

You may not use our services for fraud, harassment, unlawful marketing, deceptive impersonation, unauthorized voice cloning, or collecting information without appropriate authorization.
You may not interfere with service security or instruct an agent to misrepresent your business, its products, or its capabilities.

11. Intellectual Property

You retain ownership of your business content. We retain ownership of our pre-existing tools, templates, software, and methods.
Ownership and permitted use of custom deliverables will be stated in your service agreement. Third-party materials remain subject to their owners’ rights and license terms.

12. Service Availability and Suspension

We take reasonable steps to maintain our services, but interruptions may occur because of maintenance, technical failures, carrier issues, or events outside our reasonable control.

We may suspend or terminate service for material breaches, unlawful use, security threats, or unpaid charges. Where practical, we will provide notice and an opportunity to resolve the issue.
Any agreed service-level commitments take precedence over this section.

13. Disclaimers and Liability

Except for commitments expressly stated in your service agreement and to the extent permitted by law, services are provided “as available,” without a guarantee that they will be uninterrupted or error-free.
To the extent permitted by law, neither party is liable for indirect or consequential losses arising from these services. This exclusion does not apply to fraud, willful misconduct, or liability that cannot legally be excluded. Nothing in these terms limits mandatory consumer rights.

14. Disputes

Please contact support@autopartsremarketing.com first so we can try to resolve a concern. Nothing in this section prevents either party from seeking available legal remedies.
Any governing-law or venue provision will be stated in your written service agreement, subject to applicable law.

15. Changes and Order of Precedence

We may update these terms and will identify the effective date. Material changes affecting existing paid services will be communicated before taking effect and will not retroactively change agreed charges or completed services.
If these terms conflict with a signed service agreement or accepted order, that agreement or order controls for the relevant service.
